LIABILITY RELEASE AND INDEMNIFICATION FORM

I, the above named participant, request voluntary participation in the Dallas Team Handball Club (“The Club”) practices, activities and events from January 1st, 2025 to December 31st, 2025 at Mustang Park Recreation Center and at all facilities used for activities and events of The Club which are hereinafter referred to as the “activity”. I consent to my participation in the activity and acknowledge that I fully understand my participation may involve risk of serious injury or death, which may result not only from my own actions, inactions or negligence, but also from the actions, inactions or negligence of others, the condition of the facilities, equipment, or areas where the activity is being conducted, and/or the rules of play of this type of event or activity. I understand that if I have any risk concerns, I should discuss the risks associated with participation with the activity coordinators and staff, before I submit this document and before participating in the activity.

Release:
I hereby release and hold harmless the City of Irving, Dallas Team Handball Club, its board of directors, officers, employees, volunteers, other participants, and agents (collectively, the “Released Parties”), of and from, and do discharge and waive, any and all claims, demands, losses, damages, and liabilities that I may have or sustain with respect to any and all damage and/or injury, of any type, arising out of my participation. I also agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.
I have noted in the Disclosure of Medical/Health Conditions section of the form anything the staff should be aware and certify that I am in good health with no physical condition that would prevent participation in the activity. Furthermore, I agree to use my personal medical insurance as primary medical coverage payment if accident or injury occurs. I consent to emergency medical treatment in the event such care is required. I agree to pay all costs associated with medical care and transportation.

Indemnification:
I further agree to indemnify, save and hold harmless the Released Parties from any and all claims, demands, losses, damages and liabilities for indemnities, contribution or otherwise with respect to any damage and/or injury, of any type, arising from my participation. I also agree that this Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement extends to all acts of negligence by the Release and is intended to be as broad and inclusive as is permitted by the laws of Texas and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

I, the above named participant, hereby grant Dallas Team Handball Club (“the Club”) permission to use, exploit, adapt, modify, reproduce, distribute, publicly perform and display, in any form now known or later developed, my image or visual likeness, my name and/or my voice (the “Personal Information”) as specified in this Release and indicated above, throughout the world, by incorporating it or them into publications, catalogs, brochures, books, magazines, photo exhibits, motion picture films, internet websites, videotapes, and/or other media (the “Works”) or commercial, informational, educational, advertising, or promotional materials relating thereto.

I release, and hereby agree to indemnify, defend, and save harmless the Club, its agents, employees, licensees and assignees (collectively, “Released Entities”) from any and all claims I, or any third party, may have now or in the future for invasion of privacy, right of publicity, copyright infringement, defamation or any other cause of action arising out of the use, exploitation, reproduction, adaptation, distribution, broadcast, performance or display of the Personal Information.

I waive any right to inspect or approve any Works that may be created using the Personal Information and waive any claim with respect to the eventual use to which the Personal Information may be applied. The Personal Information may be used at the Club’s sole discretion, with or without my name, alone or in conjunction with any other material of any kind or nature except that Club will not use the Personal Information for any criminal or illegal purposes or in a manner inconsistent with community standards of decency.

I understand and agree that Club is and shall be the exclusive owner of all right, title, and interest, including copyright, in the Works, and any commercial, informational, educational, advertising, or promotional materials containing the Materials.

I am of full legal age and have read this release and am fully familiar with its contents. If I am not of full legal age, my parent(s) or legal guardian(s) must indicate, on behalf of their minor child, their full and unqualified consent to the terms of this Release & License.
